These terms and conditions are your contract with us for provision of any Retreat Services you book with us and by making a booking with us you confirm your acceptance of these terms and conditions.

 In this document, "you" and "your" include the lead-named person on the confirmation email (who must be at least 18 years old at the time of booking) and all persons on whose behalf you make a booking.

These are the agreed terms


 Definitions

"Retreat"

means any retreat and associated activities or accommodation constituted in the services we offer.

"Retreat Services"

means our service in providing a Retreat.


 Yoga Field and Sea Limited Retreat Services vary. Whatever service you choose, the terms of this contract will apply unless we indicate otherwise.

1. Booking and Payment

1.1 The contract between us comes into existence when we send our Confirmation email. You will have undertaken to pay fully for your booking and we will have undertaken to provide you with the Retreat we describe on our website. If we are unable to accept your booking, we will of course return your payment to you immediately.

 1.2 For you to make a booking, we require your deposit and full completion of all online booking pages, as provided on our website. Our confirmation will be sent to you by email. We may decline your booking for any reason and we do not have to give you the reason. If that happens we will return your money to you immediately and in any event within 14 days.

 1.3 Your authority to book for others

1.3.1 If you make a booking on behalf of others as well as yourself, you guarantee that you have the authority of each of those other people to enter into the contract and that you and they have agreed to be jointly and severally liable to us. You now accept personal liability for the acceptance and compliance of each of those people, with these contract terms.

1.3.2 It is your responsibility to ensure that all of the details on your travel documents are correct and notify us of any discrepancy or misunderstanding immediately. We shall also look only to you for making payments as they become due, ensuring the accuracy of the personal details and other information supplied by other members of your party and for whatever liaison communication is necessary between you and each other party to keep them fully informed.

1.3.3 As lead member of your party, we will deal only with you in our correspondence.

1.4 What is included in the price of a Yoga Field and Sea Limited Retreat?

●   Accommodation and all meals (unless otherwise stated in the itinerary);

●   Activities as set out in the itinerary

●   Services of one or more representatives of Yoga Field and Sea Limited

1.5 What is NOT included?

Travel arrangements are your responsibility and at your own cost. Yoga Field & Sea shall not be held liable for any consequences arising from delays, cancellations, or mix ups in any of your travel arrangements While we can help advise on transfers to/from the local train stations to the Retreat these travel arrangements are at your own cost, unless otherwise specified.
1.6 Retreat prices and deposit and balance payment

1.6.1 We reserve the right to alter prices shown in any of our marketing literature or on our website and we will inform you of any price changes prior to the issue of our Confirmation email. Once our Confirmation email has been issued then, save in the case of manifest error, any price changes may only be made in accordance with the remaining provisions of these Terms and Conditions and we particularly draw your attention to the clause 1.7.4 below in relation to surcharges

1.6.2 Please check your Confirmation email together with all other documents we send you as soon as you receive them. Contact us immediately if any information which appears on the Confirmation email or elsewhere appears to be incorrect or incomplete, as it may not be possible to make changes later. We regret we cannot accept any responsibility if we are not notified of any inaccuracies in any document within ten days of our sending it out. Whilst we will do our best to rectify any inaccuracies notified outside these time limits, you will be responsible for any costs and expenses involved in doing so.

1.6.3 When you make your booking, we shall ask you for a deposit of £250. Deposits are non-refundable, except as mentioned below, but in some cases may be transferable to another Yoga Field and Sea Limited Retreat. The balance of the price must be paid at least two weeks before your departure date. If the balance is not paid on time, we shall cancel your travel arrangements and retain your deposit.

1.6.4 Payments via our website (i.e. deposits) can be made by credit or debit card via a secure payment system. We do not store credit card details nor do we share such details with any third parties. Any such payments are made subject to the terms and conditions of the secure payment system provider.

1.6.5 Balance payments are to be made by a bank transfer to the bank account details stated on the Confirmation email.

1.6.6 Any booking made less than 2 weeks prior to the departure date must be accompanied by full payment at the time of making the booking.

1.6.7 We will not change the price of your Retreat once we have accepted your booking by sending you a Confirmation Invoice

1.7 Minimum participants required for the Retreat

1.7.1 A minimum number of participants are required in order for the Retreat to go ahead. Therefore we have a right to cancel any Retreat for which there are insufficient reservations.

1.7.2 In the event of any such cancellation, all deposits or other payments made specifically to Yoga Field and Sea Limited will be refunded in full.

1.7.3 We reserve the right to cancel any Retreat, for which there are not enough bookings, not less than 14 days prior to the departure date. In the event of our cancellation, your deposit (and any other payment you may have made to us) will be refunded in full, or, if you prefer, transferred to an alternative Yoga Field and Sea Limited Retreat.



2. Changes and Cancellation by you

2.1 Changing your booking

2.1.1 We will always do our best to help you with any change to your booking. However, we give no guarantee that we shall succeed. If you require any change, you must tell us by email or in writing. A change will be subject to an administration charge of £20 plus any costs we incur in making the change for you. 

2.2 Transferring your booking

2.2.1 If you would like to transfer your booking from one person to another, the following terms apply:

a) Anyone who takes part in a trip in place of anyone who was originally due to take part must agree to these Terms and Conditions and any other requirements which apply to the booking before the change can be finalised.

b) If the full cost of the trip should already have been paid when the change is requested but has not been, this must also be paid before the change can be finalised.

c)      We may be unable to transfer the booking if the sex of the replacement is not the same as the original person on the booking due to the fact that we often used shared accommodation.

2.2.2 You must inform us about your intention to transfer your booking to the transferee at least seven days before the departure date in writing or through email.

2.2.3 You and the transferee will accept that you and he/she will be jointly and severally liable for full payment of any outstanding sums due in respect of the booking as well as fees, charges or other costs arising from the transfer.

2.2.4 Our administration charge for a transfer made more than 7days before departure is £20. For transfer made within 7 days before departure the administration charge is £40

2.2.5 We will not refund or compensate you if changes made to your booking, or re-booking, leave you paying for parts of the Retreat Service which you do not use.

2.3 Cancellation by you

2.3.1 If you or a member of your party needs to cancel your booking, you must tell us by email or in writing. We will not accept a cancellation by telephone alone. If the cancellation is made more than 90 days before the start of the retreat a cancellation fee of £40 is payable. Your deposit will be returned minus the £40 fee cancellation fee. If the cancellation is made within less than 90 days before the start of the retreat, we will retain the deposit of the retreat. If the cancellation is made within 30 days of the start of the retreat we will retain the full amount paid by you.

2.3.2 In any of the above circumstances, we will return any money due to you within 14 days.

2.4 Travel Insurance

We strongly recommend that you obtain travel insurance to cover the activity of your Retreat with us as well as unexpected cancellation, sickness, losses and all the usual risks. It is your responsibility to organise suitable travel and health insurance. You acknowledge that Yoga Field & Sea Ltd is not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially or otherwise.

You understand and acknowledge that it is a condition of booking that you must take out an adequate travel insurance policy that covers all items listed in the sample itinerary for your chosen Retreat, as well as but not limited to, trip cancellation insurance, and any other activities that which may reasonably be undertaken during the course of your Retreat. The policy and insurance coverage must be valid and in effect for the entire duration of your Retreat.





3. Changes and cancellation by us

3.1 Because we make arrangements far in advance, we sometimes have to change an arrangement and occasionally even cancel a Retreat.

3.2 We will always inform you as soon as possible about any change. If that happens we will provide you with the following alternatives:

a) accept the change; or

b) accept our offer of alternative arrangements of a comparable standard; or

c)  Accept our offer of alternative arrangements of a lower standard together with a refund of the difference in price;

d) cancel your booking, whereupon we will give you a full refund of all money paid.

We will not compensate you for minor changes outside our control.

 

3.3 Provided your final payment has been made we will cancel your travel arrangement only in circumstances where we have no choice but to do so. If we have to cancel your trip we will provide you with three alternatives:

a) alternative arrangements of equivalent or of very closely similar standard and price, if available, or

b) alternative arrangements  of a lower standard together with a refund of the difference in price; or

c)      cancel your booking with a full refund of all monies paid.



3.4 Changes during the trip

Activities are often weather and sea condition dependent and therefore, in order to be safe, these activities might need to be changed or cancelled. In the circumstances changes or cancellations can be made at the last minute. Our representatives or any third party operating an activity will determine if they can proceed and you will be expected to comply with their instructions. There will not be a refund of any part of the Retreat price if activities are unable to proceed.


4. Complaints

4.1 Your point of contact during the Retreat will be Natalie Cordrey, info@yogafieldandsea.co.uk, 07500 032781

If you have a problem during your retreat, please inform Natalie immediately and she will endeavor to put things right. If you complain only after you have returned home, we shall not be able to investigate the problem - for your benefit and ours. If that happens, you may lose your right to compensation.

4.2 If you feel our representative has not resolved to your problem, please write to us within 14 days of your return giving us full details of your Retreat and concise details of the complaint and any subsequent history.

4.3 Please note that we cannot be held responsible for the individual behavior of any group member or other guest sharing your accommodation.

5. Your responsibilities

5.1 Special requests

Any special requests relating to your travel arrangements must be sent to us at the time of booking in writing. While we try to meet your reasonable requests, we do not guarantee that they will be fulfilled. If we are able to confirm a special request, we will do so by confirmation in writing to you at least 2 before your departure date.

5.2 Passport, visa and immigration requirements

It is extremely important that you obtain and carefully check travel and immigration documents required for each member of your party to attend a Retreat.  You alone are responsible for obtaining required travel documents for your party. We do not accept responsibility for any delay or problem which may occur in this connection. If we have local representation at the time of any such problem, we will assist you as far as reasonably possible to resolve it. However, for the benefit of other people on that Retreat, it will not be possible to delay or change travel arrangements or events which will affect others in the tour group.

5.3 Documentation

You are responsible for ensuring that all details passed to us for all members of your party for the purposes of your booking and documentation generally are complete and accurate. If information that you supply to us is inaccurate then you may not be allowed to take part in the trip and you will not be entitled to any compensation.

We will send out final details of your trip at least 2 weeks before the start date. Please ensure that you contact us if you have not receive a final itinerary and other necessary documentation 7 days before the trip commences.

5.4 Your Health and Wellbeing

5.4.1 Most Yoga Field and Sea Limited Retreats require reasonable physical fitness and appropriate clothing and footwear.

5.4.2 Prior to the start of the retreat it is your responsibility in relation to any yourself and for every member of your party to:

a) consult a doctor with an understanding of all the planned activities to check that you are sufficiently fit and healthy to take part and;

b) let Yoga Field & Sea know if you have any injuries or other conditions which may impact your ability to take part in the planned activities. If you experience any injury or discomfort during activities on the retreat, please listen to your own body and desist immediately.

c) advise Yoga Field & Sea of any mental or physical health conditions, allergies and dietary requirements. If such conditions or requirements may be affected by the retreat activities we reserve the right to advise you to desist or decline your stay at our retreats.

5.4.3 If in our reasonable opinion, your chosen arrangements are not suitable for the medical or physical problem or disability or you are not travelling with someone who can provide all assistance that may be required, we have the right to refuse to accept the booking or you may not be able to participate in certain parts of a trip, in which event we shall not be liable for any losses or compensation arising. If you do not give us full details of any medical or physical problem or disability at the time of booking and/or promptly inform us of any adverse change to or a new medical or physical problem or disability that arises after booking, then we can also cancel the booking when we find out the full details if in our reasonable opinion the arrangements are not suitable in the circumstances.

5.4.4 You acknowledge that the retreat homes are in the countryside where the coastal paths are uneven. We shall not be responsible for any injuries caused by uneven terrain or for any injuries sustained during our swims, paddle boards, surfs or other retreat activities.

5.4.5 We cannot accept pregnant women on retreat with us.

6.4.6 If we provide medical help to you, whether or not you specifically ask for it, we will provide receipts for all costs (for your insurer) and you now agree to repay us that cost on your return from the Retreat.

5.4.7 Travel Insurance

Travel insurance is highly recommended. You alone are wholly responsible for arranging your insurance. The period of cover should start no later than the date you make your booking with us. Please ensure that your travel insurance covers the activities of this retreat as well as unexpected cancellation, sickness (including Covid-19 or the need to isolate due to contact with someone with Covid-19), losses and all other risks associated with traveling and taking part in the retreat. You should bring your travel insurance policy with you in case of an emergency.

5.4.8 Behaviour

If at any time, it is our opinion (given by any of our staff or representative) that you are acting in a way which may cause accident, injury, discomfort or extreme displeasure to any other member, we may exclude you from the programme for the remainder of the Retreat. You will understand that this extreme action will not be taken lightly but may be necessary to protect the health, safety or enjoyment of other travellers.

5.4.9 Retreat Accommodation and Sharing

6.4.9.1 The retreats are offered to guests of both sexes and therefore you understand that the retreat is open to both men and women. Bedrooms may be shared by men and women who book together and choose to do this as they know each other (e.g. friends, partners, couples). Yoga Field & Sea will never ask guests who do not know each other to share with the opposite sex.

5.4.9.2 Where individuals opt to share with another guest they will be placed in a room with same sex guests. To this end, occasionally we may not be able to take/confirm your booking if the only spaces left are in rooms with the opposite sex.

5.4.9.3 It is possible, depending on the retreat home and the bedroom you are assigned that you will be sharing bathrooms facilities with the opposite sex.

5.4.9.4 You understand that retreat homes vary with regards to privacy and most bedrooms or tents will not have locks.

5.4.10 Possessions

The retreat home will be empty when all guests and retreat hosts are out on activities but it will be securely locked. For glamping retreats the bell tents do not have locks. It is your responsibility to ensure that your possessions are kept safe at all times. We cannot be held responsible for any loss or damage to personal belongings or hire cars during the retreat.

6. Limitations on our liability

6.1 We want you to enjoy your Retreat with Yoga Field and Sea Limited. We shall do our best to make this experience special for you and we are responsible for the proper performance of all Retreat Services included in the contract. Nonetheless, we must make clear the limitations in law.

6.2 If we fail to provide the Retreat set out on our website or in our brochure and to which these terms apply, we will pay you appropriate compensation. We are not liable if any failure is due to:

6.2.1 your own carelessness or negligence in any aspect of your behaviour whilst on the Retreat;

6.2.2 medical emergencies;

6.2.3 changes we reasonably make to an itinerary or to accommodation or any other aspect of the management of your booking;

6.2.4 some third party unconnected with the provision of travel arrangements where we could not reasonably have foreseen or avoided those circumstances;

6.2.5 any other unusual and unforeseeable circumstances beyond our control;

6.2.6 a specific event or series of events which we or our contractors or providers could not reasonably have foreseen or prevented;

6.3 We and you are subject to international conventions, when they apply. This may limit the amount of a claim you may make, against us or anyone else.

6.4 The services and features included in your booking are those specified in our website. If you choose to buy other goods or services during your Retreat, those are not part of our service, even if our representative helps you to buy or arrange them. Accordingly we are not liable to you for any happening in connection with that service or goods.

6.5 We are not liable for any injuries you may incur. Yoga classes, swims, hiking, paddle boarding and other activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.



7. Third party suppliers

Many of the services we provide, including options which may occur from time to time during your Retreat, are provided by third parties and not directly by us. Each has their own terms and conditions. Whilst the law provides that we are liable to you in the round, for any failure connected with such a provider, our obligations do not cover every contractual term. Accordingly, instances may arise where you have no redress.


Yoga Field and Sea Ltd holds no responsibility for the actions or omissions of third parties or independent contractors, including in the event that they modify the nature of a service on a Retreat as compared with the advertised nature of the service.



8. Privacy Policy

Yoga Field and Sea Limited takes your privacy seriously and will only use your personal data in accordance with the Data Protection Act 2018 as fully described in our full Privacy Policy 

9. Photography

I irrevocably authorise Yoga Field and Sea Limited to use photographs of me and or my property and authorise Yoga Field and Sea Limited to use and publish (with or without my name) photographs or images in any and all forms and media. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release.

10. Miscellaneous

10.1 If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

10.2 Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.

10.3 No failure or delay by any party to exercise any right, power or remedy will operate as a waiver nor indicate any intention to reduce that or any other right in the future.

10.4 The parties agree that electronic communications satisfy any legal requirement that such communications be in writing.

10.5 In the event of a dispute between the parties to this agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.

10.5 This agreement does not give any right to any third party under the Contracts (Rights of Third Parties) Act 1999 / Contracts (Rights of Third Parties) (Scotland) Act 2017 or otherwise, except that any provision in this agreement which excludes or restricts the liability of the directors, officers, employees, subcontractors, agents and affiliated companies of a party, maybe enforced under that Act.

10.6 Any communication to be served on either of the parties by the other shall be delivered by hand or sent by first class post or recorded delivery or by e-mail.

It shall be deemed to have been delivered:

- if delivered by hand: on the day of delivery;

- if sent by post to the correct address: within 72 hours of posting;

-if sent by e-mail to the address from which the receiving party has last sent e-mail: within 24 hours if no notice of non-receipt has been received by the sender.

10.7 The validity, construction and performance of this agreement shall be governed by the laws of England and Wales and the parties agree that any dispute arising from it shall be litigated only in that country.
